That lawsuit was dismissed by an Amsterdam court on Tuesday afternoon, arguing that the contract signed by the author was “unbalanced but not void.” It is also “incomprehensible why Houellebecq participated in the recordings if he found the agreement really problematic”. In addition, the plaintiff would have had sufficient time between the signing of the contract and the shooting to refuse to take part in the film.

Houellebecq had challenged the validity of his contract with Kirac in court, saying he was depressed while filming the film. He was also tired and drunk when he signed the contract and didn’t know “what he was getting himself into”. The verdict was “very disappointing” for Houellebecq, his Dutch lawyer Jacqueline Schaap told AFP.

It was the second lawsuit that the author had unsuccessfully filed against the artist collective Kirac. A French judge had previously ruled in February, in January released trailers of “Kirac 27” do not violate Houellebecq’s privacy. Despite this, the film’s premiere, originally scheduled for March 11, has been postponed indefinitely.
